Affiliate Program Agreement

This Affiliate Program Agreement ("Agreement") is between Crush It Media Group LLC ("Company," "we," "us"),
operator of Crush It Engine (crushitengine.com), and you ("Affiliate"). By enrolling in the Crush It Engine affiliate
program you agree to these terms.
1. Enrollment
You must have an account in good standing and accept this Agreement to participate. We may
approve or decline any applicant and may modify or discontinue the program at any time. You are
an independent contractor; this Agreement creates no employment, partnership, agency, or joint
venture.
2. Commissions
- Rate. You earn 25% of the net subscription price of each qualified sale you refer.
- Duration. Commissions are paid on the referred customer's first plan-subscription payment
and each renewal, for up to twelve (12) months from that customer's first payment. After
twelve months, recurring commissions on that customer end. - What qualifies. Plan subscription fees only. Add-ons, one-time charges, setup fees,
usage-based charges, and account credits are not commissionable. "Net" excludes taxes,
processing fees, refunds, and chargebacks. - Self-referrals excluded. You may not earn commissions on your own account or accounts you
control. Rate changes apply only to sales made after the change and never reduce commissions
already earned.
3. Attribution
Referrals are tracked on a last-click basis and locked in when the referred customer creates
their account — the customer is bound to the affiliate whose link was most recently stored in
their browser at signup. Attribution is permanent once set (a later link cannot change it) and
remains subject to the twelve-month commission cap. Tracking depends on the visitor's browser and
may be blocked or cleared; our records are the sole and final basis for attribution.
4. Payments
- Commissions are held for a 30-day clearance period and are payable only after the underlying
sale has not been refunded or charged back. - Payouts are made once your cleared balance reaches $50 (USD).
- Payments are made via Stripe to a connected Stripe account you set up. Stripe collects and
holds your banking and tax details; we do not store them. - Refunds, chargebacks, and fraud reverse the related commission, which may be deducted from
current or future payouts.
5. Taxes
You are responsible for all taxes on your commissions. U.S. affiliates must provide a Form W-9
before payment; we issue a Form 1099-NEC where required (generally $600 or more per year).
Non-U.S. affiliates must provide the appropriate Form W-8.
6. FTC & advertising compliance
You must comply with the FTC Act and the FTC Endorsement Guides (16 CFR Part 255). Clearly and
conspicuously disclose your affiliate relationship near every referral link. All claims about
Crush It Engine must be truthful, non-misleading, and substantiated. You must comply with CAN-SPAM, the
TCPA, and all applicable privacy and marketing laws.
7. Prohibited conduct
You may not: send spam or unsolicited messages; bid on Company trademarks or confusingly similar
terms in paid search; use cookie-stuffing, forced clicks, or deceptive tracking; make
self-referrals or fraudulent orders; offer unauthorized coupons, rebates, or cashback; make false
or exaggerated earnings claims; promote on illegal, adult, or infringing sites; impersonate the
Company; or register domains, handles, or accounts using Company marks. Violations forfeit unpaid
commissions and may result in termination.
8. Intellectual property
We grant you a limited, revocable, non-exclusive license to use our name and approved marketing
materials solely to promote Crush It Engine under this Agreement. All goodwill inures to the Company. You
gain no other rights.
9. Term & termination
Either party may terminate this Agreement at any time, for any reason. On termination your license
ends and your links stop earning. Earned, cleared commissions remain payable unless termination
is for breach or fraud, in which case unpaid commissions are forfeited.
10. Disclaimers & liability
The program is provided "as is" with no guarantee of earnings. To the maximum extent permitted by
law, our total liability under this Agreement is limited to the commissions paid to you in the six
(6) months before the claim. You will indemnify us against claims arising from your promotional
activities or breach of this Agreement.
11. Governing law
This Agreement is governed by the laws of the State of Florida, and any dispute will be resolved
in the state or federal courts located in Hillsborough County, Florida.
